Mumbai/New Delhi: Questions have been raised over the apparent removal or loss of visibility of an ArthLabh news report concerning the proposed SME initial public offering of Rosmarta Digital Services, with the publication examining whether the article may have been targeted through a copyright complaint submitted to Google.
The report, originally published by ArthLabh on November 10, 2024, was titled “Demand for Investigation from SEBI, Finance Minister against SME IPO of Rosmarta Digital Services.” The article discussed complaints reportedly made to regulatory and government authorities concerning the proposed IPO and referred to allegations involving promoters and individuals associated with Rosmarta Digital Services. The article remains accessible on the ArthLabh website at the time of publication.
ArthLabh is now examining whether the article, or its URL in Google Search, was affected by a copyright-removal request that the publication believes may have been improperly made. The publication is reportedly collecting documentary and technical evidence, including historical search results, copies of the article, publication records, correspondence, screenshots, website records and information concerning any copyright complaint associated with the URL.
The matter has also raised questions about the identity and authority of any person or organisation that may have submitted such a complaint. Vivek Nagpal has been identified by ArthLabh as a person whose possible involvement is being examined; however, publicly available evidence reviewed for this report does not independently establish that Nagpal submitted a fraudulent copyright complaint or caused the article to be removed from Google Search.
Google’s Transparency Report confirms that the company receives copyright requests seeking removal of URLs from Search and that, where a notice is complete and meets Google’s requirements, Google may delist the specified URL. The Transparency Report also records the number of URLs submitted by copyright owners and the resulting removal outcomes
The distinction is significant because an apparent disappearance from Google Search, by itself, does not establish who submitted a complaint, whether a complaint was genuine, or whether any person acted unlawfully. Establishing those facts would require examination of the underlying notice, the claimant’s identity, the material allegedly protected by copyright, Google’s records concerning the request and other relevant technical evidence.
ArthLabh says it is preserving evidence before approaching the appropriate authorities. Depending on what the evidence establishes, the publication may seek investigation into whether an online copyright-removal mechanism was misused to suppress access to legitimate journalistic content.
The proposed complaint would be expected to place before investigators the original publication records, evidence of the article’s authorship and publication date, historical evidence concerning its indexing status, any available information about the alleged copyright claim, and technical or documentary material connecting the complaint to the person or entity under investigation.
The underlying November 2024 ArthLabh report itself contains allegations concerning Rosmarta Digital Services and individuals associated with the company. Those allegations should not be treated as judicial findings merely because they appeared in the published report
रोसमारटा डिजिटल सर्विसेज के एसएमई आईपीओ के खिलाफ सेबी, वित्त मंत्री से जांच की मांग
मुंबई- एसएमई आईपीओ को लेकर अब पहली बार सेबी और वित्त मंत्रालय व अन्य विभागों के पास शिकायतें पहुंचनी शुरू हो रही हैं। हाल में सेबी ने कई बार इस एक्सचेंज के इश्यू में मिल रहे भारी भरकम सब्सक्रिप्शन को लेकर चिंता जताई थी। अब एक ऐसी कंपनी के खिलाफ सेबी और वित्त मंत्रालय के पास शिकायत पहुंची है, जो कई तरह की जानकारियों को छिपा रही है। साथ ही सेबी से बिना मंजूरी मिले इसके इश्यू प्राइस, साइज और आईपीओ की तारीखों को बाजार में घुमाया जा रहा है।
तीन साल पुरानी कंपनी रोसमारटा डिजिटल सर्विसेज के प्रमोटरों के खिलाफ भारतीय प्रतिभूति और विनिमय बोर्ड (सेबी), वित्त मंत्रालय सहित सीबीआई व प्रवर्तन निदेशालय तक हैं। कंपनी एसएमई आईपीओ से 200 करोड़ रुपये जुटाने के लिए अगले हफ्ते बाजार में उतरने वाली है। कंपनी के प्रमोटरों कार्तिक विवेक नागपाल, करण विवेक नागपाल और ट्रस्ट प्रमोटर आरती नागपाल और अन्य अज्ञात व्यक्तियों पर डीआरएचपी में महत्वपूर्ण तथ्यों व जानकारी को जानबूझकर छिपाने और गलत वित्तीय आंकड़े देने का आरोप है।
प्रमोटरों के पिता विवेक नागपाल पर आरोप है कि वे पूंजी बाजार में हेरफेर, अंदरूनी व्यापार और मनी लॉन्ड्रिंग और अन्य संगठित अपराध में शामिल थे और आज भी कई माध्यम से सक्रिय हैं। मुंबई के निवेशक रोहित विजय निर्मल ने आरोपी व्यक्तियों और अन्य अज्ञात सहयोगियों के खिलाफ शिकायत दर्ज कराई है। कंपनी ने महत्वपूर्ण तथ्यों को जानबूझकर दबाने और व्यावसायिक गतिविधियों और हितों के बारे में सामग्री की जानकारी छिपाई व झूठी और गलत जानकारी दी है।
विवेक नागपाल के खिलाफ पहले भी हेरफेर, मनी लॉन्ड्रिंग, बैंकों से ली गई कर्ज राशि की हेराफेरी और अन्य संगठित वित्तीय अपराध की गतिविधियों में शामिल होने की शिकायत है। रोसमारटा के खिलाफ काफी मामले लंबित हैं जिसमें करोड़ों की फर्जी बैंक गारंटी भी शामिल है। विवेक नागपाल पर संयुक्त संसदीय रिपोर्ट के अनुसार 2001 में शेयर बाजार के घोटालेबाज केतन पारेख और अन्य के साथ सक्रिय भागीदारी के लिए मुकदमा चलाया गया था और दोषी ठहराया गया था।
विवेक नागपाल को सेबी ने प्रतिभूति बाजार में प्रवेश करने से भी पांच साल के लिए प्रतिबंधित कर दिया था। रोसमारटा डिजिटल , रोसमारटा समूह का हिस्सा है और विवेक नागपाल रोसमारटा के तहत विभिन्न व्यवसायों से जुड़े हुए हैं। पिछले कुछ वर्षों में उन्हें कई विवादों और कानूनी चुनौतियों का सामना करना पड़ा है।
डीआरएचपी के पेज 75 के मुताबिक, रीना राय को तीन मार्च, 2021 से 30 मार्च, 2024 के बीच आरडीएसएल के 30,000 इक्विटी शेयर जारी किए गए थे। रीना ‘रेबा सिक्योरिटी सॉल्यूशंस की पूर्व निदेशक भी हैं। रीना अभी रेबा एंड संस एलएलपी और रेबा इंडस्ट्रीज एलएलपी में नामित पार्टनर हैं। इन सभी का एक ही पंजीकृत पता है जो सेक्टर 18, गुरुग्राम में है। रेबा सिक्योरिटी आरडीएसएल के प्रमोटर समूह का हिस्सा है।
दिलचस्प यह है कि अभी तक सेबी से इस आईपीओ को मंजूरी नहीं मिली है, फिर भी इसका प्राइस बैंड, लॉट साइज और एंकर बिडिंग (14 नवंबर, 2024), इश्यू ओपनिंग (18 नवंबर, 2024) और इश्यू क्लोजिंग (21 नवंबर, 2024) की सूचनाएं बाजार में घूम रही हैं। कंपनी ने वेबसाइट पर भी जानकारी दे दी है।
रोसमारटा का राजस्व और लाभ देखें तो अचानक उछल गया है। 31 मार्च, 2022 को इसका राजस्व 20 लाख रुपये और घाटा तीन लाख रुपये था। इस साल 31 मार्च को अचानक राजस्व 84 करोड़ रुपये और फायदा 10.56 करोड़ रुपये हो गया। सितंबर तिमाही में तो फायदा 14.83 करोड़ के पार चला गया है।
